(Illustrative image)

The legal starting point is the Education Act of 1982, Batas Pambansa Blg. 232 (BP 232). Section 27 makes school operations subject to prior government authorization and calls for “a permit system”. DepEd’s detailed rules are in DepEd Order No. 88, s. 2010, the 2010 Revised Manual of Regulations for Private Schools in Basic Education, amended by DepEd Order No. 11, s. 2011. A 2016 memorandum of DepEd Region VII quotes the key sections:

Section 28, Authority to Operate: institutions can operate only when authorized by the Department, and the Regional Director approves the establishment of private pre-schools, elementary and high schools and learning centers.

Section 29, Permit and Recognition: government authority for private basic education schools is of two kinds, a permit and a recognition.

The document itself is titled “Government Permit (Private)”. One issued by DepEd Region VIII in 2022 grants a named school “a temporary permit to operate” Kindergarten for one school year only, cites Republic Acts No. 9155 and 10533, and shows the school’s SEC registration number and TIN. It does not extend to any branch, annex or other grade, and can be revoked if standards slip.

Government Permit vs Government Recognition

“Permit to operate” can mean three things: the first permit, the yearly renewal, and later recognition. Here they are side by side, in the wording of DepEd field office pages.

Item

Government Permit (new)

Renewal of Government Permit

Government Recognition

What it does

Lets a private school open a new Kindergarten, Elementary (Grades 1–6) or Junior High School (Grades 7–10) program, or additional grade levels

Lets the school continue the program

Confirms the school meets national standards; lets it issue nationally recognized credits and diplomas

How long it lasts

One school year

One school year at a time

Indefinite, while the requirements of law, rules and standards are met

Who may apply

A private school planning a new program

Schools granted a permit in the last school year

Schools that have operated for the required probationary period

Filing route

Letter of intent to the Regional Director through the Schools Division Superintendent; the division evaluates, then the Regional Office (Quality Assurance Division) issues

Legal effect

Temporary authority to operate

Temporary authority continues

Under BP 232 Section 28, turns the temporary permit into permanent authority; graduates get the same benefits as those of other recognized schools

Based on the citizen’s charter of the DepEd Schools Division Office of Zambales, the DepEd Region VII memorandum and BP 232. Senior High School programs have their own permit process.

What to settle before you apply

Three things take longer than the application itself. Settle them first.

1. A registered school corporation

BP 232 Section 25 says a proposed private school must incorporate under the Corporation Code, a requirement that may be waived for family-administered pre-schools. Every DepEd checklist we read asks for the school’s SEC registration and Articles of Incorporation. Ask a lawyer which corporate form fits your plan; this guide is not legal advice.

2. A site and a building you can document

DepEd asks for documents of ownership of the site and buildings and an occupancy permit. A 2026 renewal memorandum of the Schools Division Office of Dasmariñas City lists a Transfer Certificate of Title (or a tax declaration), a deed of donation, a lease of at least 10 years or a deed of usufruct, and a certificate of occupancy with the type “Institutional/Education only”. DepEd Order No. 26, s. 2023, as relayed by the same division, gave some schools extra time on permit requirements, but not on SEC requirements or the local government’s occupancy permit. The building is the item you cannot postpone.

3. A notarized feasibility study

The Region VII guidelines say that failing to submit it is ground for outright dismissal. It must cover:

The purpose and objectives of the proposed school or course

The site and building, with ownership documents, location and development plans, and pictures or an architect’s plan

The itemized cost: site, building, classrooms, equipment, library, salaries and maintenance

Financial capacity to run year to year without depending solely on students’ fees

The proposed faculty and staff, with transcripts, eligibility and evidence they will join

The need for the school locally, including distance to existing schools and names of prospective pupils

DepEd permit to operate requirements: the checklist

SEC papers, the budget, the bank certificate and the proposed fees are easier with an accountant at the same table. NIJIN is looking for one person to start NIJIN Academy Philippines and lead it, as business head and principal. In the Zambales charter, you pay the application and inspection fee, submit the documents to Records, and the division evaluates them (5 days), validates them (3 days) and endorses the file to the Regional Director. The charter’s total is 9 days, 1 hour and 20 minutes; Angeles City states 10 days, 4 hours and 35 minutes, including an onsite validation and a post-conference.

Expect visits. In January 2026 the Dasmariñas City division scheduled a pre-ocular inspection for private schools applying for a new permit to operate or Government Recognition, ahead of the joint onsite inspection by the Regional and Division Offices, and told schools to have original documents on hand.

After the first year: renewal and recognition

Under the rules quoted by Region VII, the temporary permit is valid for one year only, and a new school must apply for renewal early in the year before the next school year opens. Dasmariñas City, for example, ran a one-stop renewal process for School Year 2026–2027.

Recognition is based on satisfactory operation, without deficiencies in instruction, administration or management, and on full compliance with the requirements of the course. Schools under a temporary permit file for it before the school year in which recognition is intended.

Why recognition matters to families. Under BP 232 Section 28, recognition entitles the school to give its graduates a certificate or diploma, and entitles those graduates to the benefits of graduates of all government-recognized schools.
