facilities, minimum working days and instructional hours, and a library, equipment and play material. Who issues the certificate, on which form and within what time is set by your state’s RTE rules, not by the Act itself.

This guide covers recognition only: what Sections 18 and 19 of the Right of Children to Free and Compulsory Education Act, 2009 say, what the Schedule asks of a new school, which duties come with the certificate, and how recognition is withdrawn. It quotes the Act as published by the Department of School Education and Literacy. It is not legal advice; your state education department has the last word.

In this article

What school recognition under the RTE Act means

What RTE recognition covers, and what it does not

The Schedule: norms and standards for a school

How many teachers a new school needs

Conditions that come with a recognition certificate

How the recognition application works

Withdrawal of recognition and penalties

Questions to ask your state education department

Another route into school leadership

Questions and answers

What school recognition under the RTE Act means

Section 18(1) says that no school, other than one established, owned or controlled by the appropriate Government or a local authority, shall be established or function after the Act’s commencement (1 April 2010) without a certificate of recognition. Section 18(2) adds the condition that matters most to a founder: no recognition shall be granted unless the school fulfils the norms and standards under Section 19, which points to the Schedule annexed to the Act.

So the certificate is the legal licence for a private elementary school to exist, and the Schedule is the test it must pass. The Ministry’s clarification note on the Act explains that government schools are not “recognised” because that would mean the government recognising its own schools, but Section 19 still requires them to meet the Schedule.

Type of school (Section 2(n))

Needs a certificate under Section 18?

Must meet the Schedule?

Established, owned or controlled by the appropriate Government or a local authority

No

Yes

Aided school receiving government or local-authority grants

Yes

Yes

Specified category (Kendriya Vidyalaya, Navodaya Vidyalaya, Sainik School and others notified)

Only if not government-run; ask the authority

Yes

Unaided school receiving no aid or grants

Yes

Yes

What RTE recognition covers, and what it does not

The Act deals with elementary education, which Section 2(f) defines as first class to eighth class, for children aged six to fourteen. Four limits are worth knowing:

Religious institutions. Section 1(5): the Act does not apply to Madrasas, Vedic Pathsalas and institutions primarily imparting religious instruction.

Minority institutions. Section 1(4) makes the Act subject to Articles 29 and 30 of the Constitution. How that applies to a school is a question for the authority and a lawyer.

Pre-primary and Class 9 to 12. Approvals for these classes, and board affiliation, come from other state rules and from the board. It is issued by the authority your state’s rules prescribe, only to a school that meets the Schedule.

Is RTE recognition required for a private school?

Yes, for elementary classes. Section 18(1) covers every school not established, owned or controlled by the appropriate Government or a local authority, aided or unaided. Section 1(5) excludes Madrasas, Vedic Pathsalas and institutions primarily imparting religious instruction.

How can I download an RTE recognition certificate?

It is issued by your state, so the way to get a copy depends on the state. Ask the issuing office or the state school education department, not an unofficial website.

What are the RTE school recognition rules for new schools?

The Act sets the standard (Sections 18, 19 and the Schedule); each state’s rules set the procedure (Section 38(2)(g) to (i)). A new school must meet the Schedule before recognition.

Is a recognition certificate the same as CBSE affiliation?

No. Recognition is granted by the state under the RTE Act; affiliation is granted by a board under its own bye-laws. See how to start a CBSE school in India.

Do I need to be a teacher to lead NIJIN Academy India?

No. NIJIN does not require teaching experience for the Country Head role. Experience of managing an organisation and hiring people is what NIJIN values most.

Lead a school in India, with a team behind you

NIJIN is looking for one person to start and lead NIJIN Academy India, as its business head and its principal.
