private school receiving ESA tuition, as a teaching service paid from an Empowerment Scholarship Account, or as support for homeschooling families), then confirm the address with the city or county planning office, fingerprint every adult, form your company, and budget around ESA payments. Curriculum and branding come after those.

Arizona is unusual. Since 2022–23 its Empowerment Scholarship Account (ESA) has been open to any resident child eligible for public school, and the ESA law says no government agency may control a nonpublic school. That gives founders room, and moves the hard questions to three places: the contract each family signs, the legal definition of a private school, and local zoning. This guide quotes the Arizona Revised Statutes we read on azleg.gov. In 2026, House bills such as HB 2580 (“ESAs; micro-schools; tutors; safety; rules”) were introduced to add one. An introduced bill is a proposal, not law, so check its status on azleg.gov. In practice, an Arizona microschool is whatever legal form its founder chooses. The statutes point to four routes.

Route

What the statute says

How families pay

Private school (a “qualified school” for ESA)

A nonpublic institution, other than the child’s home, teaching for at least the same days and hours each year as a public school (A.R.S. 15-802); must not discriminate on race, color or national origin (15-2401)

Tuition and fees, including from an ESA if staff are fingerprinted (15-2402)

Teaching or tutoring service

ESA money may pay for tutoring or teaching by an individual not subject to state board discipline, or by an accredited facility (15-2402)

From each child’s ESA, as a service the parent directs

Support for homeschooling families

A homeschool is conducted primarily by the parent, or is instruction in the child’s home (15-802)

Directly by the family; ESA families may not file a homeschool affidavit

Charter school

A public school with its own zoning rule (15-189.01)

Public funding, no tuition; a much longer road

A summary of statutes we read, not a full list of duties. A two-mornings-a-week group is unlikely to meet that test; a full-time program in a rented room may. If you want ESA tuition as a qualified school, design your calendar to meet it and keep attendance records that prove it.

The affidavit. For a child at a private school or homeschool, the parent files an affidavit of intent with the county school superintendent within thirty days. For ESA families, the signed agreement itself counts as the attendance 15-802 requires, and they must not file a homeschool affidavit. The state’s school zoning rule, section 15-189.01, is written for charters: they are classified like district schools for zoning and its fees, may operate wherever a district school could not be legally prohibited, and get expedited hearings. Even so, a city or county may bar a charter on less than an acre in an existing single-family residential zone, and building and life-safety codes apply.

We found no matching state rule for private microschools in the statutes we read. A private microschool therefore depends on how the local code classifies it: a school, a home occupation, a tutoring business, a place of assembly, or nothing at all. For ESA tuition as a qualified school, staff with unsupervised contact must be fingerprinted, and a private school must teach the same days and hours as a public school. Local zoning, building and fire rules apply to the address.

Can a microschool accept Arizona ESA funding?

Yes, two ways in A.R.S. 15-2402: tuition at a qualified school that fingerprints staff, or tutoring and teaching services by an eligible individual or accredited facility. The parent spends the money, and you may not rebate any of it.

How do I start a microschool in Arizona as a teacher?

Your experience helps, but a founder also hires, budgets and wins parents’ trust. On the tutoring route, the ESA condition is that you are not subject to state board discipline. Form the entity, check zoning and do the break-even math before leaving your job.

How can I start a microschool in Arizona with no money?

Start with the cheapest legal version: a small group in a shared or hourly space, a short trial, and families who commit before you spend. Or lead an existing school model where investment is optional.

Can an Arizona microschool be online?

Partly or fully. ESA money may pay for a nonpublic online learning program. A hybrid lets a small site offer more subjects and peers, as NIJIN Academy does in Japan.

I searched for Arizona microschool jobs. Is the Country Head role a job or a business?

Closer to founding a business. You lead NIJIN Academy US as business head and principal, and can begin on a service contract alongside your current work. Contract type, location and start date are discussed in the interview.

Found NIJIN Academy in the United States

NIJIN is looking for one founder to start and lead NIJIN Academy US.
